Terms & Conditions

These terms govern the professional relationship between Mekhala Chambers and its clients. Please read them carefully before engaging our services.

1. Introduction and Scope

These Terms and Conditions ("Terms") apply to all legal services provided by Mekhala Chambers ("we," "us," or "the Firm"), a legal practice registered under Thai law with its principal office at 88 Sathorn Road, Silom, Bang Rak, Bangkok 10500.

By instructing Mekhala Chambers, whether in writing, by telephone, or by electronic communication, you ("the Client") confirm that you have read, understood, and agree to be bound by these Terms. If you do not accept these Terms, please do not proceed with an instruction.

These Terms, together with any engagement letter issued to you, form the entire agreement between the Firm and the Client in respect of the services described. In the event of any conflict, the specific provisions of the engagement letter shall take precedence over these general Terms.

2. Services Offered

Mekhala Chambers provides the following categories of legal service relating to pension and Social Security matters:

  • Pension Letter and Response Drafting — preparation of written correspondence to the Social Security Office or relevant pension authorities, including initial inquiries, replies to formal demands, and follow-up letters, each accompanied by a brief strategy note.
  • Negotiated Settlement Support — structured assistance through negotiated resolution of pension disagreements, including informal discussions with the relevant authority, mediation facilitation where available, and preparation of any settlement instrument.
  • Comprehensive Tribunal Representation — end-to-end representation in Social Security Tribunal and Labour Court proceedings, covering case theory, evidentiary review, witness coordination, full advocacy at hearing, and preparation of appellate filings where applicable.

The specific scope of services to be provided will be confirmed in a separate engagement letter issued prior to commencement of work.

3. Fees and Payment

Our current service fees are as follows:

  • Pension Letter and Response Drafting — ฿2,500 per engagement
  • Negotiated Settlement Support — ฿6,000 per engagement
  • Comprehensive Tribunal Representation — ฿10,800 per engagement

Fees are payable in Thai Baht. A deposit may be required at the commencement of the engagement, the amount and timing of which will be specified in the engagement letter. Remaining balances are due upon completion of the relevant stage of work or as otherwise agreed in writing.

Fees quoted are for professional services only. Disbursements — including court filing fees, courier charges, official translation costs, and any other third-party expenses incurred on your behalf — will be charged separately and are payable upon presentation of an itemised account.

The Firm reserves the right to review its fee schedule periodically. Any changes will be communicated to existing clients in advance and will not affect fees already confirmed in an issued engagement letter.

4. Client Responsibilities

To enable the Firm to carry out its work effectively, the Client agrees to:

  • Provide accurate, complete, and timely information and documents as requested by the Firm.
  • Promptly inform the Firm of any change in circumstances that may be relevant to the matter.
  • Respond to communications from the Firm within a reasonable time.
  • Attend any meetings, hearings, or mediation sessions as required and advised by the Firm.
  • Not approach the opposing party or relevant authority directly without first informing and consulting with the Firm where the matter is under active representation.

The Firm cannot be held responsible for delays or adverse outcomes arising from the Client's failure to meet these obligations.

5. Confidentiality

All information disclosed by the Client to the Firm in the course of the engagement is treated as strictly confidential. We will not disclose such information to any third party except:

  • Where disclosure is necessary to carry out your instructions (for example, to the relevant authority or opposing counsel);
  • Where required by law, court order, or a competent regulatory authority;
  • With your express prior consent.

Our confidentiality obligations continue after the termination of the engagement. The Firm's Privacy Policy, available at privacy-policy.html, provides further detail on how personal data is collected, used, and protected in accordance with Thailand's Personal Data Protection Act B.E. 2562 (2019) ("PDPA").

6. Intellectual Property

All documents, letters, submissions, and other work product prepared by the Firm in connection with your engagement ("Work Product") are prepared for your personal use in the context of the matter described in the engagement letter. The copyright in the Work Product remains with Mekhala Chambers unless expressly transferred in writing.

The Client may use the Work Product for the purpose for which it was prepared but may not reproduce, adapt, or distribute it for any other purpose without prior written consent from the Firm.

7. Limitation of Liability

The Firm provides legal services with reasonable care and professional skill. However, outcomes in legal proceedings and negotiations are subject to many factors outside the Firm's control, and no assurance of any particular result can be offered or implied.

The Firm's aggregate liability to the Client in respect of any claim arising from the services rendered shall not exceed the total fees paid by the Client for the specific engagement to which the claim relates.

Nothing in these Terms limits or excludes liability for fraud, wilful misconduct, or any other liability that cannot be limited or excluded under applicable Thai law.

8. Termination

Either party may terminate the engagement by giving written notice. The Client acknowledges that termination at certain stages of proceedings may have practical or legal consequences, and the Firm will advise accordingly.

Upon termination, the Client remains liable for fees and disbursements incurred up to and including the date of termination. Work Product prepared prior to termination will be made available to the Client upon settlement of any outstanding balance.

The Firm reserves the right to cease acting in the matter if the Client fails to comply with these Terms, acts in a manner that compromises the professional obligations of the Firm, or fails to settle fees when due, subject to any applicable professional conduct rules.

9. Complaints and Disputes

If you have any concern about the services provided, we ask that you raise it with the Firm in the first instance by writing to us at [email protected] or by telephoning +66 2 591 4836. We are committed to addressing concerns promptly and in good faith.

Any dispute arising from or in connection with these Terms that cannot be resolved informally shall be subject to the jurisdiction of the courts of Bangkok, Thailand, and governed by the laws of Thailand.

10. Amendments

Mekhala Chambers may update these Terms from time to time. The revised Terms will be published on this website with an updated effective date. Continued use of our services after publication of revised Terms constitutes acceptance of those revisions. For ongoing engagements, material changes will be communicated directly.
